Debating execution of judgments
A law on civil judgment execution is being drafted to contain more specific and comprehensive provisions aiming to ensure equal rights of the involved parties, Nguyen Thanh Thuy, deputy director of the Justice Ministry’s Civil Judgment Execution Department told a JICA-supported workshop on the draft law.

The draft is also designed to add appropriate coercive measures, enhance jurisdiction of executors, reorganize judgment execution bodies and attract participation of other organizations and individuals in judgment execution work, the deputy director said.

According to Japanese experts, the draft should ensure performance of judgment execution bodies and balance interests among the plaintiff, the defendant and parties with related rights and obligations.

They suggested that the country study the hand-over of the right to select judgment execution measures to the plaintiff.-
