Decree No. 119/2011/ND-CP: Competition case files to be transmitted via net

The Government issued on December 16 Decree No. 119/2011/ND-CP to amend a number of articles of Government Decree No. 116/2005/ND-CP of September 15, 2005, stipulating administrative procedures under the Competition Law.

Under this Decree, in addition to a written dossier of economic concentration notification or an explanatory report of parties to a competition or economic concentration agreement, a dossier of complaint about a competition case may be sent in the form of soft files scanned from the original dossier or text files, which bear official and lawful digital signatures of involved business parties’ legal representatives, transmitted via the computer network.

The competition management agency’s written replies to economic concentration notices must be addressed to business registration offices and other agencies competent to permit merger, consolidation, acquisition or joint venture according to law and parties to economic concentration deals and their lawful representatives.

In the course of examination of explanatory reports on satisfaction of conditions for immunity from economic concentration inspection, the competition management agency may collect opinions of related scientific and technological research and development institutions.

This Decree will take effect on February, 2012.-
