Law on Law Dissemination and Education

(No. 14/2012/QH13)

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;

The National Assembly promulgates the Law on Law Dissemination and Education.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Law provides for citizens’ right to be informed of law and responsibility to inquire into and study law; contents and forms of law dissemination and education; responsibilities of competent agencies, organizations and individuals; and conditions for law dissemination and education activities.

Article 2. Citizens’ right to be informed of law and responsibility to inquire into and study law

1. Citizens have the right to be informed of law and the responsibility to take the initiative in inquiring into and studying law.

2. The State guarantees and creates conditions for citizens to exercise their right to be informed of law.

Article 3. The State’s policy on law dissemination and education

1. Law dissemination and education rests with the entire political system, of which the State plays the core role.

2. The State ensures necessary resources for law dissemination and education activities.

3. To socialize the law dissemination and education; to commend and reward agencies, organizations and individuals that record active contributions to law dissemination and education.

4. Law education in educational institutions of the national education system is incorporated in curricula of all education grades and training levels; and constitutes a content of curricula of lower secondary education, upper secondary education, vocational education and higher education.

Article 4. Socialization of law dissemination and education activities

The State encourages and adopts policies to support and provide conditions for agencies, organizations, enterprises and individuals to participate in law dissemination and education; and mobilizes social resources for law dissemination and education.

Based on the socio-economic situation in each period, the Government specifies the policies to support agencies, organizations, enterprises and individuals participating in law dissemination and education.

Article 5. Principles for law dissemination and education

1. Accuracy, adequacy, clarity, understandability and practicality.

2. Promptness, regularity, with focus and focal points.

3. Diversity of forms of law dissemination and education suitable to needs, age groups and qualifications of law dissemination and education target subjects, and to traditions, fine customs and practices of the nation.

4. Association with the law enforcement, performance of socio-economic development, defense and security maintenance tasks of the nation, localities and with people’s daily life activities.

5. Close coordination among agencies, organizations, families and society.

Article 6. State management of law dissemination and education

1. Contents of the state management of law dissemination and education include:

a/ To elaborate and issue legal documents, programs and plans on law dissemination and education;

b/ To direct, guide and organize law dissemination and education activities;

c/ To provide legal knowledge and train in law dissemination and education skills;

d/ To establish and manage the national database on law;

e/ To make statistics on, and final review of, law dissemination and education;

f/ To inspect, examine and settle complaints and denunciations about, and handle violations in law dissemination and education;

g/ To undertake international cooperation on law dissemination and education.

2. Agencies performing the state management of law dissemination and education include:

a/ The Government, which performs the unified state management of law dissemination and education;

b/ The Ministry of Justice, which is answerable to the Government for the state management of law dissemination and education; assumes the prime responsibility for formulation and submission to the Prime Minister for promulgation of programs, long-term and medium-term plans on law dissemination and education; and assumes the prime responsibility for building the national database on law;

c/ Ministries and ministerial-level agencies, which shall, within the scope of their respective tasks and powers, coordinate with the Ministry of Justice in performing the state management of law dissemination and education;

d/ The People’s Committees at all levels, which are responsible for performing the state management of law dissemination and education in their respective localities.

Article 7. Law dissemination and education coordinating councils

1. Law dissemination and education coordinating councils are set up at the central level, in provinces, centrally run cities, rural districts, urban districts, provincial capitals and towns, and act as advisory bodies for the Government, provincial-level People’s Committees or district-level People’s Committees on law dissemination and education and mobilization of resources for law dissemination and education.

2. Standing bodies of law dissemination and education coordinating councils are the Ministry of Justice, for the Government; Justice Departments, for provincial-level People’s Committees; Justice Sections, for district-level People’s Committees.

3. The Prime Minister shall specify the composition, tasks and powers of law dissemination and education coordinating councils.

Article 8. The Law Day of the Socialist Republic of Vietnam

November 9 every year will be taken as the Law Day of the Socialist Republic of Vietnam. The Law Day shall be organized to honor the Constitution and law and to educate the sense of law observance of all the people.

The Government shall detail this Article.

Article 9. Prohibited acts

1. Falsely transmitting, critizing contents of disseminated law; failing to supply information and documents as provided by law; supplying information and documents with untruthful contents which are contrary to law, social morality and fine national traditions.

2. Taking advantage of law dissemination and education to distort the Party’s undertakings and lines or the State’s laws; propagating hostile policies, splitting the national unity bloc; infringing upon the interests of the State, the rights and legitimate interests of agencies, organizations or individuals.

3. Preventing citizens from exercising their right to be informed of, to inquire into and study law, or the law dissemination and education activities of agencies, organizations or individuals.

4. Abusing the right to be informed of, to inquire into and study law to obstruct normal operations of agencies, organizations and/or individuals, or to cause public disorder and social unsafety.

Chapter II

CONTENTS AND FORMS OF LAW DISSEMINATION AND EDUCATION

Section 1

CONTENTS AND FORMS OF GENERAL LAW DISSEMINATION AND EDUCATION FOR CITIZENS

Article 10. Contents of law dissemination and education

1. The provisions of the Constitution and legal documents, focally the provisions of law on civil, criminal or administrative affairs, marriage and family, gender equality, land, construction, environmental protection, labor, education, health, defense, security, transport and the basic rights and obligations of citizens, powers and responsibilities of state agencies, cadres and civil servants, and newly promulgated legal documents.

2. Treaties to which the Socialist Republic of Vietnam is a contracting party, and international agreements.

3. The sense of law respect and observance; the sense of law protection; benefits of law observance; good people and good deeds in law observance.

Article 11. Forms of law dissemination and education

1. Press briefings, press communiqués.

2. Direct law dissemination; consultancy and guidance on law inquiries; supply of legal information and documents.

3. Through the mass media, public-address systems, the Internet, billboards, posters; publication of legal documents on Cong Bao (Official Gazette); publication of legal information on websites; posting at offices or notice boards of agencies, organizations, population quarters.

4. Organization of law knowledge contests.

5. Through trial or handling of administrative violations, citizen reception, settlement of complaints and denunciations of citizens and other activities of agencies in the state apparatus; via activities of legal assistance, grassroots reconciliation.

6. Incorporation in cultural, literary and artistic and routine activities of political organizations, mass organizations, clubs, law bookcases and other grassroots cultural institutions.

7. Through programs on law education in educational institutions of the national educational system.

8. Other forms of law dissemination and education suitable to every specific subject, which competent agencies, organizations or individuals may apply to ensure efficient law dissemination and education.

Article 12. Press briefings, press communiqués on legal documents

1. The State President’s Office assumes the prime responsibility for, and coordinates with the National Assembly Office and drafting agencies in, organizing press briefings and issuing press communiqués on laws and ordinances or legal norm-containing resolutions of the National Assembly and National Assembly Standing Committee after they are signed for promulgation by the State President.

2. Every month, the Ministry of Justice assumes the prime responsibility for, and coordinates with the Government Office and drafting agencies in, issuing press communiqués on legal documents issued by the Government or the Prime Minister.

3. Press communiqués must clearly state the necessity and purposes of issuance, and principal contents of legal documents.

Article 13. Publication of legal information on websites

1. The following legal information must be published on websites of ministries, ministerial-level agencies, government-attached agencies, the Supreme People’s Court, the Supreme People’s Procuracy, the State Audit, the Vietnam Fatherland Front Central Committee, central bodies of socio-political organizations, provincial-level People’s Councils and People’s Committees:

a/ Legal documents related to fields of operation of these agencies or organizations;

b/ Legal documents issued by these agencies or jointly by these agencies and organizations;

c/ Administrative procedures directly related to citizens and enterprises which fall under the responsibility of these agencies and organizations;

d/ Draft legal documents put up for public comments as provided for by law.

2. In addition to the information prescribed in Clause 1 of this Article, agencies and organizations are encouraged to publish on their websites other information on law elaboration and enforcement, law questions and answers necessary for the people.

Article 14. Law dissemination and education in the mass media

The Vietnam Television Station, Radio Voice of Vietnam, Vietnam News Agency, Nhan Dan (People) daily, papers of law protection agencies, provincial-level papers, radio and television stations shall formulate special programs, pages and columns on law; diversify forms of law dissemination and education so as to popularize legal provisions, law enforcement and other information on law.

Article 15. Consultancy, guidance on law inquiry, supply of legal information and documents

1. Agencies, organizations and individuals that are considering and settling cases or affairs of citizens shall explain and supply legal provisions directly related to such cases or affairs or guide the search therefor on the national database on law, when so requested by those citizens.

2. The State adopts policies to encourage law consultancy organizations, other legal service organizations, law training establishments and research institutions to provide consultancy and guidance on law study, to supply legal information and documents free of charge to people.

Article 16. Law dissemination and education through trial, handling of administrative violations, reception of citizens, settlement of complaints and denunciations

1. People’s courts at all levels may select appropriate cases of educative value for mobile trial in order to disseminate and educate law among court hearing participants and people.

2. Competent state agencies shall organize, through the handling of administrative violations, reception of citizens, settlement of complaints and denunciations, dialogues with citizens for law dissemination and education.

Section 2

CONTENTS AND FORMS OF LAW DISSEMINATION AND EDUCATION FOR A NUMBER OF SPECIAL SUBJECTS

Article 17. Law dissemination and education for people in ethnic minority areas, mountainous, deep-lying, remote, border and coastal regions, islands, regions with exceptionally difficult socio-economic conditions and fishermen

1. Law dissemination and education for people in ethnic minority areas, mountainous, deep-lying, remote, border and coastal regions, islands, regions with exceptionally difficult socio-economic conditions and fishermen shall, depending on the characteristics of different subjects, focus on legal provisions on nationality, religion, responsibility to participate in the protection and maintenance of security, defense, borders, national sovereignty, seas, islands, natural resources, minerals and other fields of law closely associated to people’s daily life and production activities.

2. Importance shall be attached to the law dissemination and education for people in ethnic minority areas, mountainous, deep-lying, remote, border and coastal regions, islands, regions with exceptionally difficult socio-economic conditions and fishermen through grassroots reconciliation, mobile legal aid; legal consultancy, free-of-charge supply of legal information and documents in ethnic minority language for ethnic minority people; incorporation of law dissemination and education in traditional cultural activities.

3. The State adopts policies on training and retraining of, and support for, persons engaged in law dissemination and education activities, village patriarchs, hamlet chiefs, prestigious persons among ethnic minority people participating in law dissemination and education in localities; creates conditions for organizations and individuals to voluntarily conduct law dissemination and education for people in ethnic minority areas, mountainous, deep-lying, remote, border and coastal regions, islands, regions with exceptionally difficult socio-economic conditions and fishermen.

4. People’s Committees at all levels shall organize law dissemination and education for people in ethnic minority areas, mountainous, deep-lying and remote regions, regions with exceptionally difficult socio-economic conditions and fishermen; assume the prime responsibility for, and coordinate with border guards, police, customs, forest protection force and marine police in, organizing law dissemination and education for people in border, coastal and island regions.

Article 18. Law dissemination and education for employees of enterprises

1. Law dissemination and education for employees of enterprises must focus on the rights and obligations of employees and employers, the law on employment, labor hygiene and safety, wage, social insurance, health insurance and unemployment insurance regimes, the law on trade union and other provisions of the labor law.

2. Activities of law dissemination and education for employees of enterprises shall be conducted with importance attached to the direct dissemination, posting of legal provisions at the workplace, law bookcases, law book baskets, leaflets or incorporation in cultural, literary and artistic activities.

3. Employers shall arrange time and ensure necessary conditions for law dissemination and education; and coordinate with trade union organizations in organizing law dissemination and education for their employees.

4. Trade union organizations shall assume the prime responsibility for mobilizing laborers to inquire into and study law.

Article 19. Law dissemination and education for victims of domestic violence

1. Law dissemination and education for victims of domestic violence shall focus on the provisions of the law on marriage and family, gender equality, domestic violence prevention and combat, responsibilities of the State and the society in supporting and protecting domestic violence victims.

2. Activities of law dissemination and education for domestic violence victims shall be conducted with importance attached to grassroots reconciliation, mobile legal aid, pro-bono legal consultancy, direct law dissemination and education at victim shelters, social relief establishments and domestic violence victim assistance establishments.

3. People’s Committees of communes, wards and townships, Vietnam Fatherland Front Committees and Front member organizations at grassroots shall organize the law dissemination and education for victims of domestic violence and domestic violence perpetrators, and mobilize organizations and individuals to provide funding support for the law dissemination and education to these subjects.

4. Families shall educate their members to implement provisions of the law on domestic violence prevention and combat, marriage and family, and gender equality.

Article 20. Law dissemination and education for the disabled

1. Law dissemination and education for the disabled must focus on the provisions of law on rights of the disabled; the regimes and policies of the State, the responsibilities of the State and the society to provide conditions and supports to the disabled and other provisions of law related to the disabled.

2. Law dissemination and education for the disabled shall be conducted with importance attached to the forms, methods, means and documents suitable to each type of disabled people.

3. The State adopts policies on training, retraining and supporting people engaged in law dissemination and education for the disabled; and encourages organizations and individuals to provide funding support for law dissemination and education for the disabled.

4. Labor, War Invalids and Social Affairs offices shall assist People’s Committees of the same level in assuming the prime responsibility for, and coordinating with the disabled’s organizations at different levels, other agencies and organizations in, conducting law dissemination and education for the disabled.

Article 21. Law dissemination and education for persons who are currently serving their prison sentences or being subject to the measure of consignment to reformatories, compulsory education institutions or compulsory detoxification establishments

1. The law dissemination and education for persons who are currently serving their prison sentences and persons who are being subject to the measure of consignment to reformatories, compulsory education institutions or compulsory detoxification establishments must, depending to each type of subjects, focus on the provisions of the law on rights and obligations of citizens, criminal law, law enforcement of criminal judgments and handling of administrative violations; the law on drug and social evil prevention and control.

2. Law dissemination and education for persons who are currently serving their prison sentences and persons who are being subject to the measure of consignment to reformatories, compulsory education institutions, compulsory detoxification establishments shall be conducted with importance attached to law study and citizen education programs and incorporated in educational, vocational-training curricula, education for community reintegration; dissemination of news and policies; activities of clubs, peer groups and other appropriate forms.

3. Detention camp superintendents, principals of reformatories and directors of compulsory education institutions and compulsory detoxification establishments shall organize law dissemination and education for inmates or persons being subject to the measure of consignment to reformatories, compulsory education institutions or compulsory detoxification establishments.

Article 22. Law dissemination and education for persons being subject to the measure of education in communes, wards or townships, and persons eligible for suspended imprisonment sentences

1. Law dissemination and education for persons being subject to the measure of education in communes, wards or townships and persons eligible for suspended imprisonment sentences must focus on the provisions of law on rights and obligations of citizens, criminal law, law on enforcement of criminal judgments and handling of administrative violations.

2. Law dissemination and education for persons being subject to measure of education in communes, wards or townships and persons eligible for suspended imprisonment sentences shall be conducted with importance attached to the forms of direct law dissemination, club activities and other appropriate forms.

3. Commune-level People’s Committees shall coordinate with concerned agencies, organizations, population communities and families of persons being subject to the measure of education in communes, wards or townships, and persons subject to suspended imprisonment sentences in organizing the law dissemination and education for these subjects.

Section 3

LAW EDUCATION IN EDUCATIONAL INSTITUTIONS OF THE NATIONAL EDUCATION SYSTEM

Article 23. Contents of law education in educational institutions of the national education system

1. Contents of law education in educational institutions of the national education system shall be formulated in conformity with each educational grade or training level, with the educational objectives and training disciplines, ensuring the consistency, synchronism, universality, fundamentality, practicality and systematism.

2. Contents of law education for each educational grade or training level of the national education system are prescribed as follows:

a/ Contents of law education in preschool and primary education programs shall be incorporated through moral education, forming habits conformable to social ethics, sense of discipline, spirit of solidarity and self-consciousness in order to create prerequisites for formation of sense of law;

b/ Contents of law education in lower secondary and upper secondary education programs must equip pupils with initial knowledge about rights and obligations of citizens, temper them in the habits and sense of law respect and observance;

c/ Contents of law education in vocational education and higher education programs must equip students with basic knowledge about the state and law, and legal knowledge about their training disciplines.

Article 24. Forms of law education in educational institutions of the national education system

1. Formal education about law through incorporation in educational activities at preschool education level; morality subject at primary education level; citizen education subject at lower and upper secondary education levels; law study, law fundamentals and specialized law at vocational education and higher education institutions; study subjects in other educational institutions of the national education system.

2. Extracurricular education and educational activities outside class hours.

Chapter III

LAW DISSEMINATION AND EDUCATION RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, INDIVIDUALS

Section 1

LAW DISSEMINATION AND EDUCATION RESPONSIBILITY OF AGENCIES AND ORGANIZATIONS

Article 25. Responsibilities of ministries, ministerial-level agencies and government-attached agencies

1. Within the scope of their respective tasks and powers, ministries, ministerial-level agencies and government-attached agencies have the following responsibilities:

a/ To promulgate according to their competence programs, schemes and plans on law dissemination and education and to direct and guide agencies and units under their respective management in the implementation thereof;

b/ To determine law dissemination and education contents and forms suitable to each group of subjects; to compile documents and disseminate specialized law knowledge; to ensure the people’s right to be provided with legal information;

c/ To organize law dissemination and education for cadres, civil servants, public employees, officers and soldiers of people’s armed forces units under their respective management, attaching importance to implementation through direct law dissemination, provision of legal documents, websites of agencies, and training, retraining or refresher courses;

d/ To build up, train and foster the contingent of law disseminators of ministries and sectors;

e/ To direct vocational training and schools establishments under their respective management to organize law education in educational institutions and vocational-training establishments; to arrange, standardize and foster the contingent of citizen education teachers, law teachers and lecturers.

2. The Ministry of Education and Training shall promulgate programs on law education in educational institutions at different study grades and training levels; prescribe the time and roadmap for completion of the standardization of citizen education teachers, law teachers and lecturers.

3. The Ministry of Labor, War Invalids and Social Affairs shall promulgate programs on law education in vocational training establishments.

Article 26. Responsibilities of people’s courts, people’s procuracies and the State Audit

1. To build, train and foster the contingent of law disseminators of their sectors.

2. To organize law dissemination and education for cadres, civil servants and public employees under their respective management; to disseminate specialized legal knowledge among people in appropriate forms.

3. To combine law dissemination and education for people with professional activities.

Article 27. Responsibilities of local administrations at different levels

1. People’s Councils at different levels have the following responsibilities:

a/ To decide on measures to raise the effectiveness of law dissemination and education; to distribute local budget estimates for law dissemination and education activities;

b/ To supervise the implementation of the law on law dissemination and education.

2. People’s Committees at different levels have the following responsibilities:

a/ To promulgate according to their competence programs, plans and schemes on law dissemination and education;

b/ To direct, guide, organize the implementation of, and inspect law dissemination and education;

c/ To build, train, foster and manage the contingent of law disseminators and propagators; to standardize the contingent of citizen education teachers, law teachers and lecturers in accordance with law;

d/ To create conditions for organizations, individuals and enterprises to support law dissemination and education activities.

Article 28. Responsibilities of agencies, organizations and units directly managing cadres, civil servants and public employees

1. To conduct law dissemination and education for cadres, civil servants, public employees and employees under their management, attaching importance to forms of direct law dissemination, publication of legal information on their websites, newspapers and bulletins (if any); to combine law dissemination and education with professional activities.

2. To ensure necessary conditions for law dissemination and education for cadres, civil servants, public employees and employees; to build, train and foster their contingents of disseminators, or periodically invite disseminators to participate in law dissemination and education in their agencies, organizations or units.

3. To coordinate with concerned state bodies or organizations in law dissemination and education for people.

Article 29. Responsibilities of Vietnam Fatherland Front Committees and member organizations of the Front

1. To organize law dissemination and education for their members; to mobilize people to abide by law.

2. To coordinate with concerned state bodies and organizations in law dissemination and education for people.

3. To build, train and foster their contingents of law disseminators and propagators.

4. To mobilize organizations, individuals and enterprises to participate in and support law dissemination and education activities.

5. To participate in supervision of the implementation of policies and law on law dissemination and education.

Article 30. Responsibilities of law-practicing organizations, socio-professional law organizations, law schools, judicial title training and fostering establishments

1. Law-practicing organizations, socio-professional law organizations, law schools, judicial title training and fostering establishments shall participate in law dissemination and education for people; organize law dissemination and education through legal consultancy and legal aid activities; combine law dissemination and education with professional activities; create conditions for their members, civil servants, public employees, lecturers, trainees and students to participate voluntarily in law dissemination and education.

2. Law schools and judicial title training establishments shall participate in fostering and raising the capacity of people engaged in law dissemination and education.

Article 31. Responsibilities of educational institutions in the national education system

1. Based on contents and forms of law education at each educational grade or training level, educational institutions in the national education system shall organize law education, arranging citizen education teachers, law teachers and lecturers in accordance with law.

2. To coordinate with families and the society in materializing the objectives of law education in educational institutions in the national education system.

Article 32. Responsibilities of families

Family members shall exemplarily abide by law; grandparents and parents shall educate and create conditions for grandchildren and children to inquire into and study law and to temper themselves in the sense of law observance and abidance.

Section 2

LAW DISSEMINATION AND EDUCATION RESPONSIBILITIES OF INDIVIDUALS

Article 33. Responsibilities of National Assembly deputies and People’s Councils deputies at all levels

Within the scope of their respective tasks and powers, National Assembly deputies and People’s Council deputies at all levels shall conduct law dissemination and education for people through their contacts with voters; and supervise the law implementation.

Article 34. Responsibilities of cadres, civil servants, public employees and officers and soldiers of people’s armed forces

1. To actively inquire into and study law; to participate in law-training courses, classes; to exemplarily abide by law.

2. To actively combine law dissemination and education with professional activities and task performance.

3. To support and assist agencies, organizations and individuals in disseminating and educating laws relevant to their respective working fields.

Article 35. Law disseminators

1. Law disseminators are cadres, civil servants, public employees and officers in people’s armed forces recognized under competent agencies’ decisions to be engaged in law dissemination and education on a part-time basis.

2. Law disseminators must fully satisfy the following conditions:

a/ Possessing good moral quality, steady political stance and professional prestige;

b/ Having communications capability;

c/ Possessing university degree in law and having worked in a legal field for at least 2 years; or having worked in a law-related field for at least 3 year, if not possessing university degree in law but having university degree in another discipline.

3. Competence to decide on recognition of law disseminators is prescribed as follows:

a/ The Minister of Justice may decide to recognize law disseminators of ministries, ministerial-level agencies, government-attached agencies, Vietnam Fatherland Front Central Committee and central bodies of member organizations of the Front;

b/ Provincial-level People’s Committee chairpersons may decide to recognize law disseminators of provincial-level state agencies, Vietnam Fatherland Front Committees and member organizations of the Front;

c/ District-level People’s Committee chairpersons may decide to recognize law disseminators of district-level state agencies, Vietnam Fatherland Front Committees and member organizations of the Front.

4. Agencies competent to issue decisions on recognition of law disseminators may dismiss law disseminators from duty. Agencies and organizations directly managing law disseminators shall check and propose competent agencies to issue decisions to dismiss law disseminators from duty.

5. Order and procedures for recognition and dismissal of law disseminators are prescribed by the Minister of Justice.

Article 36. Rights and obligations of law disseminators

1. Law disseminators have the following rights:

a/ To be provided with legal documents, information and materials in service of the performance of their law dissemination and education tasks;

b/ To be trained or retrained in legal knowledge and law dissemination and education skills and operation;

c/ To be entitled to remunerations and entitlements provided by law.

2. Law disseminators have the following obligations:

a/ To perform the law dissemination and education tasks as assigned; to accurately provide law dissemination and education contents;

b/ Not to disclose state secrets and not to commit other prohibited acts;

c/ To annually report on their law dissemination and education activities to agencies or organizations directly managing them.

Article 37. Law propagators and persons invited to participate in law dissemination and education at grassroots level

1. Persons who are prestigious and knowledgeable about law are considered to be recognized as law propagators in communes, wards or townships or invited to participate in grassroots law dissemination and education.

2. Commune-level People’s Committee chairpersons may decide to recognize law propagators.

3. Law propagators and persons invited to participate in law dissemination and education may be provided with legal documents, trained or retrained in legal knowledge and law dissemination and education skills and operations; and enjoy remunerations and entitlements provided by law.

CONDITIONS FOR LAW DISSEMINATION AND EDUCATION

Article 38. Conditions of organization and personnel, physical foundations and facilities for law dissemination and education activities

Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People’s Committees at all levels, presidents of Vietnam Fatherland Front Committees and heads of member organizations of the Front shall arrange sufficient cadres, civil servants, public employees, law disseminators and propagators for law dissemination and education activities to meet law dissemination and education demands in fields or localities under their respective management; and ensure physical foundations and facilities necessary for law dissemination and education in accordance with the Government’s regulations.

Article 39. Funds for law dissemination and education

1. Law dissemination and education funds of budget-financed agencies and organizations are provided by the state budget and mobilized from other lawful sources. The central budget provides law dissemination and education funding supports for localities, budgets of which are unable to fund these activities.

2. Every year, based on the law dissemination and education tasks of the following year, agencies and organizations shall make and include law dissemination and education fund estimates in their state budget estimates before submitting them to competent authorities for decision in accordance with the law on the state budget.

3. The State encourages and creates conditions for domestic and foreign organizations and individuals to provide aids and funding supports for law dissemination and education activities in accordance with law.

Chapter V

IMPLEMENTATION PROVISIONS

Article 40. Effect

This Law takes effect on January 1, 2013.

Article 41. Implementation detailing and guidance

The Government and competent agencies shall detail and guide the implementation of articles and clauses of this Law as assigned to them.

This Law was passed on June 20, 2012, by the XIIIth National Assembly of the Socialist Republic of Vietnam at its 3rd session.-
