Vietnam adopts plan for legal aid reform by 2025

The Prime Minister adopted on June 1 a 10-year plan to reform the country’s legal aid system, in the hope of improving the quality of legal aid services while streamlining the organizational structure of state-run legal aid centers.

The plan, which is approved under Decision No. 749/QD-TTg, sets the overall objective of accelerating socialization of legal aid activities according to a roadmap suitable to the situation of each region and area. After 2025, all legal aid providers will be practicing attorneys so as to ensure the quality of legal aid services provided to beneficiaries. State-run legal aid centers will no longer directly provide legal aid services but perform the state management of legal aid activities. Meanwhile, administrative procedures for accessing legal aid services will be radically reformed.

To this end, the 2006 Law on Legal Aid will be soon revised. From now until the revised Law on Legal Aid comes into force, attention will be paid to improving the quality of legal aid activities, attaching importance to the participation in legal proceedings, non-litigation representation, legal advice and pre-litigation counseling.

In this period, state-run legal aid centers will be streamlined toward cutting administrative expenses and focusing resources on improving the quality of legal aid services, while mobilizing the involvement of social organizations in legal aid activities. Each center will be composed of two sections of which one will directly provide legal aid services and the other will manage professional operations. This can be regarded as a preparative step for the transformation of  state-run legal aid centers into watchdog agencies in the next period when conditions permit.-
