The Party and the State have always paid attention to improving institutions and policies for cultural development, considering it a prerequisite for making culture a spiritual foundation, an objective as well as a strong motivation for the cause of national construction and defense. This is affirmed at the Culture Workshop 2022 held last December in Bac Ninh province under the theme “Institutions, Policies and Resources for Cultural Development”. Vietnam Law & Legal Forum magazine would like to introduce to readers this article, which is based on the speech delivered by Minister of Culture, Sports and Tourism Nguyen Van Hung, member of the Party Central Committee, at the workshop.

Under the 2020 Investment Law, investors are defined as organizations or individuals carrying out business investment activities, including domestic investors, foreign investors and foreign-invested economic organizations. Foreign investors are subsequently defined as foreign nationals or organizations established under foreign laws that carry out business investment activities in Vietnam; and domestic investors as Vietnamese nationals or economic organizations without any members or shareholders being foreign investors.

The 2013 Land Law has provisions aiming to narrow down the gap in land access between foreign and local land users. Nevertheless, those provisions still reveal shortcomings and therefore need to be revised for attracting more foreign investment in Vietnam. This article provides an evaluation of current land regulations applicable to foreign entities investing in Vietnam and proposes some amendments to the land legislation so as to guarantee the rights of foreign investors in the country.

The 1982 UNCLOS boosted the development of Vietnam’s laws on the sea.
