Decree No. 24/2013/ND-CP: Inter-country marriage of border inhabitants free from registration fee

Registrations of marriages and recognition of parents or children involving foreigners residing in border areas is now fee free.

This is provided in Government Decree No. 24/2013/ND-CP of March 28 detailing the implementation of a number of articles of the Marriage and Family Law regarding the marriage and family relations involving foreign elements.

Accordingly, those who apply for marriage registration, the recognition of parents or children, issuance of authenticated copies of marital status certificates or recoding in household registration books of the recognition of parents or children of Vietnamese citizens by foreign authorities must pay a fee.

The time limit for marriage registration in Vietnam will be 25 days from the date the provincial-level Justice Departments receive a complete and valid dossier and a fee. The time limit of 20 days will apply to the marriage registration at representative agencies from the date these agencies receive a complete and valid dossier and a fee (against current 30 days).

The recognition of parents between Vietnamese citizens and foreigners, between Vietnamese citizens with one party residing overseas and between foreigners with one party permanently residing in Vietnam may be effected only if recognising and recognised people are still alive by the time of filing the dossier and the recognition is voluntary and dispute-free.

Commune-level People’s Committees in border areas carry out procedures for marriage registration and recognition of parents or children between Vietnamese citizens permanently residing in border areas and citizens of neighbouring countries who permanently reside in areas bordering Vietnam in accordance with this Decree and other regulations on registration of household registration books.

The new regulation will take effect on May 15 and supersedes Government Decree No. 68/2002/ND-CP of July 10, 2002.-
