DECREE No. 08/2009/ND-CP: Rewards for domestic violence activists

To detail a number of articles of the Law Against Domestic Violence which took effect on July 1, 2008, the Government on February 4 issued Decree No. 08/2009/ND-CP to specify the setting up and operation of establishments to assist domestic violence victims and provide consultancy on domestic violence prevention and combat, and other non-public organizations engaged in these activities as well as incentives they are entitled to like those operating in socialized education, job training, health care culture, sports and environmental protection.

When requested in writing by domestic violence victims or their lawful guardians or concerned local agencies, commune People’s Committee presidents may decide to ban domestic assaulters from contacting their victims again for three days, provided an assault has been actually done on the victims, threatening their life or harming their health.

Unless there is a solid wall, fence or another effective partition between the assaulter and the victim, the former is prohibited from approaching the latter within 30 meters. Violence doers are also banned from using telephones, fax, e-mail or other communications devices to threaten to use violence against their victims.

People who die, get injured and suffer from 21% working capacity reduction, or record merits in preventing or combating domestic violence will be recognized as fallen heroes, entitled to policies like invalids, and commended or rewarded.-
