Decree No. 103/2012/ND-CP: Region-based minimum wage increased

From January 1, 2013, the region-based minimum wages will be between VND 1.650 million and 2.350 million for employees of enterprises, cooperatives, cooperative groups, farms, households, individuals, agencies and other organizations.

This is provided in Government Decree No. 103/2012/ND-CP of December 4, 2012, and applicable to enterprises established, organized, managed and operating under the Law on Enterprises (including Vietnam-based foreign-invested enterprises); cooperatives, cooperative unions, cooperative groups, farms, households, individuals and other organizations of Vietnam; and foreign agencies, foreign organizations, international organizations and foreigners employing labor in Vietnam.

Region-based monthly minimum wage levels are divided into four groups of VND 2,350,000, 2,100,000, 1,800,000 and 1,650,000 applicable to enterprises operating in localities of regions I, II, III and IV, respectively.

Minimum wages are payable by employers to their untrained laborers performing the simplest job under normal working conditions for a certain number of working days in a month and fulfilling labor norms.

The minimum pay for trained laborers (including those trained by their employers) must be at least 7 per cent higher than the region-based minimum wage.

The Decree also encourages enterprises to pay wages higher than the minimum wage levels to their employees.-
