Under Decree No. 26/2011/ND-CP of April 8, amending a number of articles of Decree No. 108/2008/ND-CP of October 7, 2008, detailing a number of articles of the Chemical Law, from June 1 directors, deputy directors and personnel specializing in chemical production must possess a university or higher degree in chemistry.
New conditions on chemical production establishments provided in the Decree include: workers directly exposed to chemicals must be trained in safety techniques; facilities used for chemical production must satisfy requirements specified in Article 12 of the Chemical Law; and these establishments must take certified measures to prevent and respond to chemical incidents or adopt chemical incident prevention and response plans.
In case establishments trading in, storing, preserving or using existing hazardous chemicals fail to meet the safety distance condition, they must immediately plan to establish such safety distances before December 30, 2012, and report thereon to ministries in charge of chemicals and provincial-level administrations.-
