Decree No. 38/2013/ND-CP: Fields prioritized for ODA, preferential loans

The Government prioritizes nine fields for official development assistance (ODA) capital and donors’ preferential loans under Decree No. 38/2013/ND-CP of Apirl 23, including building of comprehensive, large-scale and modern economic infrastructure system (roads, railways, airports, seaports and inland waterways); urban infrastructure (transport, water supply and drainage, sanitation and electricity supply); information technology and communication infrastructure; energy infrastructure (for development of renewable and new energies); irrigation works and dikes.

Developing social infrastructure for culture, healthcare, education and training, vocational training, social security, poverty reduction, population and development; developing science and hi-tech sectors, sourcing technology and science and technology for prioritized and key areas, knowledge-based economy and high-quality workforce; developing agriculture and rural areas eligible for ODA and preferential loans from foreign donors.

Strengthening institutional capacity and administrative reform; protecting the environment and natural resources, preventing and mitigating impacts of natural disasters, coping with climate change, pursuing sustainable development and green growth; supporting trade, investment, finance, banking, tourism and a number of production and business fields to strengthen the competitiveness of the economy; and assisting the implementation of national target programs will be prioritized.

Under the Decree, to receive ODA capital and preferential loans, the capability of managing the implementation of programs and projects of project investors in the private sector must be certified by governing or on-lending agencies.

For on-lending of ODA capital and preferential loans, financial plans of programs and projects and financial capability of project investors must be verified in accordance with current regulations and the Ministry of Finance’s guidance.

The Decree also specifies four forms for the private sector to get ODA and preferential loans, including borrowing from domestic financial and credit institutions within credit limit or limit component programs and projects funded with ODA capital and preferential loans; implementing programs and projects in the fields prioritized for ODA and the Government’s preferential loans on-lent by the State budget, implementing the public-private partnership programs and projects in which the Government contributes ODA and preferential loans; and implementing programs and projects supporting the private sector.

The Decree will take effect on June 6.-
