From June 1, the new regulation on business registration promulgated together with Government Decree No. 43/2010/ND-CP of April 15 will apply, permitting enterprises to register their business operation online through the national information system (portal) for business registration.
Specifically, business registry offices will receive and examine application dossiers filed online like paper dossiers, guide dossier modification or supplementation and notify business registration results through the system.
Enterprise owners having no e-signatures can also make online business registration by obtaining approval and printing out certification of submission of their business registration dossiers through the system before signing and sending such certification to provincial-level business registry offices of Planning and Investment Departments in localities where their enterprises are located, for consideration and grant of business registration certificates.
Also under the new regulation, replacing Decree No. 88/2006/ND-CP of August 29, 2006, the time limit for completion of business registration procedures by provincial-level registry offices is shortened to five working days from current 10 days. In case of delay, business registrants may lodge a complaint.
An enterprise registering its business operation will receive a sole identification number referred to as enterprise code which is also used as tax identification number.
An enterprise making business registration with a name identical to that of another enterprise previously registered is not required to rename.-
