DECREE No. 60/2009/ND-CP: Violators of judicial regulations to face penalties

From September 18, violators of judicial regulations may face fines of up to VND 30 million under Government Decree No. 60/2009/ND-CP of July 23, on sanctioning of administrative violations in the judicial field, which replaces Decree No. 76/2006/ND-CP of August 2, 2006.

Accordingly, persons already in receipt of second-time summons of court judgment enforcers but fail to show up at indicated places will be given a caution or fined VND 50,000-200,000. A fine of VND 200,000-300,000 will be sanctioned for failure or delay to apply provisional urgent measures as required by effective court judgments or rulings, or for modification or erasure of certified true copies or originals of documents subject to compulsory certification.

Persons who disperse or damage assets subject to distraint for judgment enforcement or shirk the distraint process, or illegally print, copy or modify their judicial records or use others’ judicial records will be fined VND 2-5 million.

Adults who treat on their marital status while making marriage registration; notaries public who notarize contracts and real estate transactions ultra vires or notarize testaments of persons who are mentally ill; providers of legal services for clients with opposite interests in the same case; suppliers of untruthful information and documents on legal aid cases which cause serious consequences will face a fine of VND 5-10 million.
