DECREE No. 93/2009/ND-CP: Revised rules on use of non-governmental aid

As defined in Decree No. 93/2009/ND-CP, on management and use of foreign non-governmental aid, this aid is that provided in support of Vietnam’s major socio-economic development and humanitarian programs and projects in agriculture and rural development, hunger eradication and poverty reduction, health care, education and employment, birth control, environmental protection, infrastructure construction, natural disaster mitigation, human resource development and legal institution building. It may also be provided in non-project form and emergency reliefs.

Foreign non-governmental aid other than emergency relief can only be received by Vietnam-based institutions, which are lawfully established and operating in domains eligible for aid, after obtaining competent authorities’ approval and notifying in writing the donors. When necessary, the receipt of aid commodities must be decided by the Prime Minister.

Only commodities outside the list of commodities banned from import can be received as aid. Particularly, used ones can only be received after they are certified by donors as still having 80% of their original value. Commodities provided as non-governmental aid are required to be auctioned under asset auction regulations.

The new regulation will take effect on January 1, 2010, and replace Prime Minister Decision No. 64/2001/QD-TTg of April 26, 2001.-
