The Ministry of Labor, Invalids and Social Affairs is gathering comments on a draft decree on unemployment insurance.

Under the 49-article draft decree, laborers to be covered by unemployment insurance include Vietnamese citizens working under labor contracts or working contracts of an unspecified term or a term of between full 12 months and 36 months.

The monthly unemployment allowance paid to laborers would be equal to 60% of the average monthly salary or remuneration of six consecutive months before they become unemployed.

To be entitled to unemployment insurance, laborers must have paid unemployment insurance premiums for full at least 12 months within two years before they become unemployed, have registered their unemployment with an unemployment insurer and have not yet found a job within 15 days after the date of registration of unemployment.

A laborer who unlawfully terminates his/her labor contract or is fired, sentenced to imprisonment, dead or declared missing would not be covered by unemployment insurance.

The provision of unemployment insurance would be suspended in case the insured fails to report to the insurer, refuses to take up a new job or participate in job-training courses recommended by the insurer or is jailed.

The draft decree would be implemented from 2009.-
