Harsher penalties for child abuse

A draft decree revising Government Decree No. 114/2006/ND-CP of October 3, 2006, on sanctioning administrative violations in the domain of population and children is being compiled by the Ministry of Labor, War Invalids and Social Affairs (MoLISA).

Mr. Ha Dinh Bon, deputy director of the MoLISA’s Legal Department was quoted by the Thoi Bao Kinh Te (Vietnam Economic Times) newspaper as saying that the draft decree would cover violations which have actually been committed in reality but not yet mentioned in any documents.

The draft decree also raises the maximum fine level to VND 40 million, imposing this fine level on those who abuse child labor or employ children to sell, purchase or transport fake or smuggled goods or banknotes across borders. If committing these violations in the country, violators would face a fine of VND 5-10 million. Violators may be also deprived of the rights to use licenses or practice permits for between three and six months.

In a family, if parents, guardians or nurturers force their children to do too heavy housework, causing adverse impacts on these children’s growth, they would face a fine of between VND 500,000 and one million.

To reduce maltreatment to HIV-infected children and children of HIV-infected persons, the draft decree stipulates that principals would be handled for any discrimination against HIV-affected children occurring in their schools.
