In furtherance of the Minister’s Decision 2994/QD-BCT dated November 11, 2024, approving the Scheme on improvement of capacity for participating in the resolution of international trade disputes in the sector of industry and trade for the 2025-2030 period, and Decision 1066/QD-BCT dated April 18, 2025, promulgating the Regulation on coordination in the prevention and resolution of international investment disputes, MOIT has geared up the performance of its tasks assigned under the 2017 Law on Support for SMEs and Decree 55/2019/ND-CP dated June 24, 2019, on legal assistance for SMEs, and enacted the 2025 plan on provision of legal assistance for SMEs under the Minister’s Decision 423/QD-BCT dated February 18, 2025.
On the above grounds, in 2025 MOIT focused on providing enterprises with adequate and timely information on amendments and supplementations to existing relevant legal documents and issuance of new ones on the Industry and Trade Legal Information Website, promptly performed the tasks assigned to it under Prime Minister Directive 10/CT-TTg dated March 25, 2025, on the promotion of the development of SMEs, and the Minister’s Decision 1256/QD-BCT dated May 7, 2025, on the sector’s plan on implementation of this Directive.
MOIT has reviewed the performance of responsibilities by the ministries and ministerial-level agencies in the provision of legal assistance to SMEs since the effective date of Decree 55 of 2019. In addition to recorded achievements, its Report 3760/BCT-PC dated May 27, 2025, to the Ministry of Justice (MOJ), reviewed difficulties and problems arising from the implementation of Decree 55, and recommended solutions to effectively implement regulations and policies on legal assissance so as to bring about practical benefits to SMEs.
The Ministry also reviewed five years’ implementation of the Program on interdisciplinary legal assistance for SMEs during the 2021-25 period under Prime Minister Decision 81/QD-TTg and reported the review conclusions to MOJ, and gave its opinions on the draft review report on five years’ implementation of Decree 55, with a view to contributing to improving enterprise support policies.
On June 20, MOIT sent Official Dispatch 4496/BCT-PC to the Vietnam Lawyers’ Federation requesting the latter’s coordination in recommending qualified lawyers and law-practicing organizations to join in the network of legal consultants providing legal assistance for SMEs in the industry and trade sector. On August 8, the Minister publicized a list of officials in charge of monitoring the provision of legal assistance for SMEs in the sector, and requested the MOIT’s attached units to accelerate the provision of legal assistance within the ambit of their functions and tasks.
