The Government Office is working on a draft decree on simplification of administrative procedures, with a view to clearing hurdles to citizens and enterprises and abolishing the “ask-and-give” mechanism.
The draft decree contains amendments to current legal documents on business registration, management and use of enterprise seals and management of investment projects on construction of works.
Regarding business registration, the draft decree supersedes Decree No. 88/2007/ND-CP which requires foreigners to produce permanent residence cards to make business registration. Instead, they may produce temporary residence cards issued by a Vietnamese competent authority and valid passports.
While Decree No. 58/2001/ND-CP requires enterprises, after receiving business registration certificates, to send an application for seal carving to provincial-level Police Departments for the latter to recommend them to seal-carving establishments, the draft decree allows enterprises to have their seals carved according to registered specimens.
Under the draft paper, the competence to grant construction practice certificates would be transferred from the Construction Minister as currently prescribed in Decree No. 16/2005/ND-CP to provincial-level People’s Committee presidents and subsequently decentralized to directors of provincial/municipal Construction Services.
It also allows provincial-level People’s Committee presidents, based on their local practical conditions, to assign district-level People’s Committee presidents to decide on investment in local budget-funded projects, regardless of their capital amount.
The draft decree also proposes simpler administrative procedures concerning management of dwelling houses, animal health, fisheries production and business conditions, transport and private medical and pharmaceutical practice.
The decree has been drafted under the scheme on simplification of administrative procedures in state management domains during 2007-2010.-
