The National Agency for Secured Transactions Registration and State Compensation under the Ministry of Justice (MOJ), in coordination with the Ho Chi Minh City Department of Justice, on April 21 organised a training conference on raising the effectiveness of the application and enforcement of the law on registration of security interests in Ho Chi Minh City.
The conference was organised in furtherance of the MOJ’s 2026 Working Plan on performance of state management tasks regarding the registration of security interests.
Participants in the conference are representatives from local authorities and organisations, including the Department of Justice, the Department of Agriculture and Environment, the Land Registration Office and its branches; credit institutions, small- and medium-sized enterprises (SMEs), bar associations, notary offices, civil judgement enforcement agencies; as well as representatives of the Centre for Registration of Transactions and Assets in Ho Chi Minh City and local media agencies.
The conference focused on updating new provisions of Government Decree 18/2026/ND-CP dated January 14, 2026, on the reduction and simplification of administrative procedures and business conditions under the MOJ’s management. These cover reduction and simplification of administrative procedures in the registration of security interests; principles of registration of security interests; effect of the registration; signatures and seals on registration application forms; refusal of registration. The decree also specifies certain cases of registration of changes, e.g., assignment of receivables, addition of secured obligations, or change of the secured party; deregistration; and a number of legal issues related to the consistent recording of the time of registration in databases and on registration application forms, etc.
At the conference, participants raised issues arising in the registration of security interests. These included the registration of mortgages for collateral being perennial crops, production forests being planted forests, and housing construction projects; the description of collateral being property rights arising from contracts, receivables, and property rights related to housing construction and urban development projects; and mechanisms for mortgaging, and registering the mortgage of existing or future assets attached to land. The participants also mentioned inconsistencies between mortgage registration information on QR codes and that in land use rights certificates.
The conference was heard that citizens still face difficulties in accessing information on mortgage of land use rights for the reason that under current regulations, such kind of information is not recorded on land use rights certificates while the land database remains inaccessible. Besides, the processing of registration dossiers for land use rights and land-attached assets via the National Public Service Portal has yet to meet the practical requirements, as paper dossiers are still required in parallel with online dossiers.
Closing the event, Nguyen Thi Thu Hang, Deputy Director-General of the National Agency for Secured Transactions Registration and State Compensation, affirmed that the conference helped unify legal understanding, address challenges, and provide valuable inputs for further improving the legal framework on registration of security interests in line with practical needs.- (VLLF)
