Aggregation of farm lands

The Ministry of Agriculture and Rural Development (MARD) is working on a draft decree on land accumulation, which is expected to be promulgated in late 2009.

According to head of the MARD’s Cooperatives and Rural Development Department, La Van Ly, this decree would encourage land accruement to promote agricultural production.

Under the draft decree, not only domestic individuals, households and organizations but also overseas Vietnamese and foreign individuals and organizations would be permitted to accumulate land for agricultural production in Vietnam. Land accumulation would be carried out through land transfer, conversion, lease and sub-lease, inheritance of land-use rights or contribution of land as equity capital to agricultural production projects.

Regarding rights and obligations of land accumulators, the draft decree clearly states that entities that receive land through accumulation will be protected by the State when their rights to use land for agricultural production under planning are infringed upon. They would be also entitled to compensation upon land recovery by the State. In addition, the State would create conditions for land users to acquire new farming techniques, get access to information on the farm produce market and use common infrastructure for production activities.-
