Business and Law Forum hoped to remove legal obstacles for enterprises

On October 9, the Central Coordination Council for Law Dissemination and Education held the 2024 Business and Law Forum in Hanoi, both in-person and online, connected with 63 localities with the participation of leaders from related departments and sectors, representatives of business associations, and entrepreneurs.

Themed “Joining hands to address legal issues, contributing to creating a favorable investment and business environment for enterprises,” the forum focused on discussing two major issues.

First, it proposed addressing a number of legal issues related to land-using investment projects. This covers identifying inconsistencies and incompatibilities between legal documents in construction investment activities and difficulties in current provisions and their implementation; and procedures and preparation time for investment projects. The forum heard that the actual time for performing licensing procedures is prolonged, causing delay in the investment process and difficulties for businesses.

Second, it raises tax-related legal issues and solutions. The forum participants suggested revising the regulations on value-added tax (VAT) refund procedures to ensure policy transparency, adhering to the principles of risk management and prompt tax refund for enterprises in accordance with the law on tax administration.

The forum also proposed amending the regulations requiring enterprises to separately declare and pay tax on profits from real estate transfer as they reveal limitations and inadequacies.

Speaking at the forum, Minister of Justice Nguyen Hai Ninh, who is also the Permanent Vice Chairman of the Council, stated that in the first nine months of 2024, the Government held nine lawmaking sessions, and promulgated 122 decrees and 215 resolutions; and the Prime Minister issued 1,129 decisions and 35 directives, and organized three meetings of the Steering Committee for review and settlement of legal issues and obstacles.

“This forum reaffirms the commitment of the Government and Prime Minister toward the business community to accompany, and protect the legitimate and lawful rights and interests of, businesses in any circumstances; and always listen to problems of enterprises and help them overcome challenges,” the Minister said.- (VLLF)
