To replace Ministry of Industry Circular No. 12/2006/TT-BCN of December 22, 2006, the Ministry of Industry and Trade on June 28 issued Circular No. 28/2010/TT-BCT, detailing the Law on Chemicals and Government Decree No. 28/2010/TT-BCT of October 7, 2010, specifying physical and technical conditions for assuring safety in industrial chemical production and trading, procedures for chemical producers and traders to obtain eligibility certificates for industrial chemicals allowed to be produced or traded under certain conditions or restricted from production or trading, and dossiers of application for permission to produce, import or use banned chemicals in industries.
Within 20 days after receiving a valid dossier, the Industry and Trade Ministry or provincial-level Industry and Trade Departments will grant a certificate of eligibility to produce or trade in chemicals subject to conditional production or trading or restricted from production or trading, respectively. Chemical producers or traders that start their operation before August 16, 2010, and wish to continue their operation should apply for permits, which are valid for three years.
