Decree No. 75/2010/ND-CP: Cultural violators to pay heavier fines

Administrative violations of regulations on cinematography, performing arts, public cultural services, cultural and artistic exhibition, photography, advertisement, cultural heritage, library, cultural product import and export and overseas publication of cultural works will be subject to new sanctions under Government Decree No. 75/2010/ND-CP of July 12, effective as of September 1.

Film shooting in areas banned from cinematographic activities will be fined VND 2-5 million. Producers of films which reveal personal privacy without filmed persons’ consent or foreign parties that modify or illegally transfer their film production licenses in Vietnam will face a fine of VND 10-15 million. Production of pornographic, violence-packed or superstitious films or videos will be liable to a fine of 25-30 million. Foreigners producing films in Vietnam without a license will be fined VND 30-40 million.

Regarding cultural product reproduction, a fine of between VN 1-40 million will be imposed on unlicensed reproducers of music or stage-play disks or tapes or pornographic videos, depending on the quantity of illegally reproduced copies.

Artists performing late (after midnight) or those performing abroad without permissions will be fined VND 3-6 million or VND 10-20 million, respectively.

Unlicensed beauty contest organizers will face a fine of VND 20-40 million. Those who abuse superstitious practices or traditional beliefs or festivals to commit illegal acts will pay a fine of VND 1-10 million.

Provision of advertisement services or installation of advertisement boards in the country by foreigners will be liable to a fine of VND 30-40 million.-
