The Government has recently issued a decree defining the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies which is expected to streamline the apparatus and clearly delineate responsibilities of, and improve the effectiveness and efficiency of state management by, these ministries and agencies.

According to Decree 303/2025/ND-CP dated November 19, ministries and ministerial-level agencies are organized and operate based on their and their heads’ clearly defined tasks, powers and responsibilities. Ministers hold the comprehensive responsibility for all activities of their ministries. Working apparatuses of ministries are organized as institutions capable of multi-sector management and in a streamlined, effective and efficient manner.

The decree, which took effect on November 20, states that the determination of the number of deputy heads of agencies and organizations must adhere to the principle that the maximum number of deputy heads of a subordinate organization must not exceed the number of deputy heads of its immediate superior organization.

The maximum number of deputy heads of an agency or organization with no internal divisions must not exceed the number of deputy heads of an agency or organization with internal divisions. Furthermore, the Decree also mandates the intensification of decentralization of powers and authorization in the organization and operation of ministries.

The decree says a ministry consists of departments and the equivalent; the office (if any); the inspectorate (if any); bureaus and the equivalent (if any) and public non-business units. A department of a ministry functions to give general or specialized advices on the state management and has its own seal and account but has no legal entity status. A department will be established if satisfying criteria on functions and scope of management and having at least 15 civil servants on state payrolls.

However, the decree’s provisions on the organizational structures of ministries do not apply to the Ministry of National Defense and the Ministry of Public Security.- (VLLF)
