Decree No. 104/2012/ND-CP: Permission for foreign military ships’ entry, stay regulated

The Government on December 9 issued Decree No. 104/2012/ND-CP of December 9, 2012, on the foreign military ships’ entry to the country. Accordingly, foreign military ships must be permitted by Vietnamese competent state management agencies to arrive in the country and must obey Vietnamese laws and regulations in this Decree, except previously agreed between their countries and Vietnamese competent agencies through the diplomatic channel.

Under the Decree, crewmembers of foreign military ships must follow the approved activity programs. Any changes of these programs must be permitted by Vietnamese state agencies. During their stay, Vietnamese flag must be flied together with the ship state flags.

If foreign military ships arrive in Vietnam for a visit, they are only allowed to anchor and operate within permitted ports and have to follow instructions of specialized competent agencies of Vietnam.

Foreign military ship crewmembers who wish to go ashore have to complete all migration and port arrival procedures and come back to their ships before the competent agencies conduct departure procedures for their ships.

This Decree will take effect on January 20, 2013.-
