From January 20, 2012, a fine of between VND 400 and 500 million will be imposed for reproducing or citing a phonogram or video recording without permission of the right holder or related right collective representation with infringing products valued at over VND 500 million.
This is provided in Government Decree No. 109/2011/ND-CP of December 2, amending Decree No. 47/2009/ND-CP of May 13, 2009, on sanctioning of administrative violations in copyright and related rights.
Under the new regulation, competent authorities may confiscate infringing articles and determine their values to serve as a basis for deciding fines to be imposed.
Selling copies of a work without permission of the copyright holder or collective representation will be subject to a fine of between 0.5 and 250 million depending on the value of infringing goods.
