DECREE No. 135/2007/ND-CP:
Sanctioning of social insurance violations

This August 16 Decree applies to Vietnamese and foreign agencies, organizations and individuals that commit acts of intentionally or unintentionally violating the social insurance law, which, however, are not crimes.

Specifically, an employer will be subject to a fine of between VND 15 million and 20 million if he/she fails to pay social insurance premiums for 501 laborers or more; between VND 10 million and 15 million, in case of 101-500 laborers; or between VND 7 million and 10 million, in case of 51-100 laborers.

Employers’ acts of failing to pay social insurance premiums within the specified time limit are subject to fines of up to between VND 7 million and 12 million, depending on the number of laborers to whom employers commit violations.

A social insurance organization may be fined at up to VND 20 million for failing to grant social insurance books or close those books within the specified time limit or to settle benefits for insured laborers, or up to VND 10 million, for improperly managing or using social insurance funds .-
