Seven cases when a couple is regarded as not violating Article 10 of the Population Ordinance regarding the family planning rule that each couple has only one or two kids are specified in Decree No. 20/2010/ND-CP of March 8, which will take effect on April 29, 2010.
Accordingly, couples of ethnic minority groups with a population of under 10,000 or in danger of population loss as officially surveyed by the Planning and Investment Ministry may have a third child.
A couple may have three or more children from the first-time birth or two or more children from the second-time birth provided they already have one common child. A couple that has only one child alive, even if this child has been offered for adoption may give a third-time birth.
A couple with their current child or children suffering from physical deformities or non-hereditary serious illness may also have a third child. A couple with wife or husband or both already having his/her own child or children may also have one or two common children from one birth.
Single women who give birth to one or two at a time also fall into one of the said cases.
The Planning and Investment Ministry has been assigned to make survey and announce once every five years ethnic minority groups with a population of under 10,000 or in danger of population loss. The Health Ministry is responsible for promulgating a list of physical deformities or serious illnesses for identifying couples eligible for the above cases.-
