Disruptive air passengers face lifetime ban
From November 27, air passengers will be banned from air travel for life if making violent or terrorist attacks at airports or airfields or establishments providing flight operation services.

The new regulation is promulgated together with Government Decree No. 92 dated October 13, on aviation security.

Accordingly, a ban from air carriage for 3-12 months will apply to disruptive passengers who fail to abide by decisions on sanctioning administrative violations in the field of civil aviation or speak out threatening words about use of bombs, mines, explosives, radioactive substances or biological weapons in check-in and quarantine areas, airfields or aircraft or provide untruthful information about the presence of bombs, mines, explosives, radioactive substances or biological weapons in these areas or aircraft, affecting normal civil aviation activities.

Such sanction will also be imposed on those who commit acts violating public order and discipline at airports and in aircraft, or using forged documents for air travel.

Passengers who relapse into committing the above acts will be banned from flying for 12-24 months. After being administratively sanctioned for the second time, they will be permanently prohibited from traveling by air if relapsing again into violations.

The Decree also allows security personnel to be equipped with and use appropriate weapons and supporting tools and require them to obey commands of aircraft commanders. To respond to in-flight acts of unlawful interference, they may act under the rules set out by the Minister of Public Security.

When receiving information about aircraft and flight security and safety threats, aircraft operators must promptly notify such to security forces at airports and airfields, and take necessary measures to assure flight safety.

This Decree will replace Decree No. 81/2010/ND-CP dated July 14, 2010, on civil aviation security, and Decree No. 51/2012/ND-CP dated June 11, 2012, revising Decree No. 81/2010/ND-CP.- (VLLF)
