With 152 articles arranged in nine chapters, the 2024 Law on Organization of People’s Courts is intended to streamline the organizational structure of people’s courts so as to raise their operation quality and efficiency, particularly in the legal process.
The Law introduces new provisions on the organization and competence to establish people’s courts. It still maintains the current regulations regarding provincial- and district-level people's courts. People’s courts include the Supreme People’s Court, superior people’s courts, provincial-level people’s courts, district-level people’s courts, specialized first-instance people’s courts and military courts.
According to the Law, persons aged full 16 years or older may attend public hearings while those aged under 16 may not enter courtrooms, except when summoned by the court.
Worthy of note, the Law gives provisions on audio and video recording at hearings and meetings. At the court hearings and meetings, audio and video recording of trial panels requires the consent of the presiding judge. Meanwhile, audio and video recording of other proceeding-conducting persons and participants requires the consent of these persons and the presiding judge. Video recording of court hearings and meetings is only permitted during the opening of such hearings and meetings, the pronouncement of judgments and announcement of decisions. Courts will make audio and video recordings of the entire court hearings and meetings if necessary to serve professional purposes, the Law says.
The Law also provides the guarantee of the effect of the court’s judgments and rulings.- (VLLF)
