Overseas Vietnamese to enjoy more general land use rights under revised Land Law
The revised Land Law, which is available in the Official Gazette (issues 25-36 of 2024), regulates that overseas Vietnamese will be allowed to enjoy the land policies like domestic citizens.

The revised Land Law, which is available in the Official Gazette (issues 25-36 of 2024), regulates that overseas Vietnamese will be allowed to enjoy the land policies like domestic citizens.

Compared to its 2013 version, the new law additionally includes overseas Vietnamese who are Vietnamese citizens and people of Vietnamese origin residing abroad in the definition of land users. As a result, they will be entitled to the general rights and privileges enjoyed by domestic land users.

Specifically, overseas Vietnamese who satisfy the specified conditions may be granted certificates of land use rights and ownership of land-attached assets and will have the same rights to reap benefits of their labor and investments on lawfully used land areas. They may also be entitled to benefits brought about by the State’s investment in the protection, rehabilitation and development of agricultural land areas.

The State will provide them with guidance and assistance in rehabilitation and restoration of agricultural land areas, and protect their lawful rights and interests upon occurrence of infringements.

In addition, they may repurpose land and enjoy compensation and support for resettlement upon land recovery by the State.

They may also file complaints and denunciations or initiate lawsuits against acts infringing upon their lawful land use rights and other violations of the land law.

Noteworthily, the revised Land Law does not distinguish domestic economic organizations from foreign-invested economic organizations in acquiring land use rights without having to satisfy conditions and carry out investment procedures applicable to foreign investors specified in the Investment Law.- (VLLF)
