Can Tho city’s Justice Department and related authorities have recently jointly held a conference to find solutions to consolidate a legal assistance system to help enterprises, particularly small- and medium-sized enterprises (SMEs), better deal with legal issues and problems, thereby ensuring their lawful rights and interests and enhancing their business administration in the context of deeper international integration.
Legal assistance was first provided in the 2017 Law on Support for SMEs, aiming to help the business community improve their legal knowledge and sense of law observance, thereby contributing to preventing and limiting legal risks and disputes in production, business and investment activities.
Based on Government Decree 55 of 2019 on provision of legal assistance for SMEs, the municipal Justice Department has regularly provided advices to the municipal People’s Committee on promulgating programs and plans on legal assistance for local SMEs in alignment with the Government’s and local administration’s regulations.
Legal assistance services for SMEs have been organized in a more and more practical manner and focused on the following key tasks: compiling and distributing legal materials to provide comprehensible and easy-to-search information to SMEs; holding conferences on legal assistance for SMEs in the city; and surveying opinions of SMEs.
The municipal Justice Department also advised the municipal administration on adopting a resolution on expenses for the provision of legal assistance for SMEs and reviewing overlapping and contradictory regulations that have caused difficulties to operations of SMEs. This was expected to serve as a basis for the city to propose amendments to the general legal assistance policies, thereby ensuring they meet practical needs of SMEs.
At the conference, Tran Phu My Thuan from TPN Education Development Investment Company said: “Labor contracts are commitments and connections between workers’ trust and employers’ responsibility. However, it is always hard to properly and fully comply with relevant legal provisions. Most problems facing enterprises are related to contract types and forms for jobs that require high flexibility while relevant regulations remain inflexible, causing difficulties in the personnel arrangement and contract breach handling. Fortunately, at the legal assissance sessions for SMEs held by the municipal administration, such problems have been solved by lawyers and legal experts.”
According to Dong Viet Phuong, Deputy director of the municipal Justice Department, over the recent years, the authorities and sectors have actively participated in advising on improvement of legal institutions, intensified the public communication and dissemination of laws, and created the most favorable conditions for enterprises to develop their production and business.
In order to promote the provision of legal assistance for enterprises to deal with legal risks, the municipal Justice Department has regularly coordinated with local departments, sectors and legal experts in holding conferences and symposiums to provide a chance for participants to exchange opinions on how to effectively resolve legal problems facing enterprises, thereby helping them firmly grasp business regulations for more efficient investment, business and management activities. The municipal Justice Department would continue advising the municipal administration on rolling out legal assistance-for-enterprises programs and activities in the city in various forms, he said.- (VLLF)
