The Department of Law Dissemination and Education and Legal Aid of the Ministry of Justice (MOJ) is currently studying and providing advices on the formulation of a decree to replace Decree 55 of 2019 on legal assistance for small- and medium-sized enterprises (SMEs) to institutionalize the Party and the State’s guidelines on the development of the private economy and to promote legal assistance for businesses in a more substantial and efficient manner.
Regarding legal assistance, the Department is developing and implementing legal assistance information system project to collect, manage and efficiently exploit information on legal assistance activities to promptly serve the direction and administration by state management agencies; further simplify administrative procedures and improve the quality of legal assistance services in alignment with the orientations for building an e-government toward a digital government, improving the quality and effectiveness of the management of legal assistance.
Furthermore, the automatic extraction of data from the database systems established under the project will enable citizens entitled to legal assistance to access and receive legal assistance promptly when needed.
The Department has focused on consolidating the network of state legal assistance centers and their local branches to suit the practical conditions of each locality and meet the requirements of the two-tier local administration model.
The Department is currently drafting the Law Amending and Supplementing a Number of Articles of the 2017 Law on Legal Aid with revisions made to further facilitate the development of legal assistance services.
With respect to institutional issues, the Department has reviewed the implementation of Decree 55 to evaluate achieved results, point out limitations and inadequacies in mechanisms and policies, and proposed solutions to improve the methods of legal assistance provision for enterprises in the coming time.
An interdisciplinary legal assistance program for SMEs, business households and cooperatives for the 2026-31 period is in the pipeline. With an expanded scope and subjects, tasks and solutions designed to be appropriate to the practical socio-economic development, digital transformation and international integration, this program aims to further promote and improve the quality and efficiency of legal assistance for enterprises and business households in the future.- (VLLF)
