Recently several important documents, most notably Politburo Resolutions No. 66-NQ/TW and 68-NQ/TW, have called for fundamental reforms in lawmaking and law enforcement, with a focus on promptly removing regulatory “bottlenecks” and fostering active participation of citizens and businesses in socio-economic development.
In this spirit, the State is determined to improve mechanisms and policies that support SMEs in line with market principles and international commitments, prioritizing resources for the private sector, especially in legal assistance, commercial dispute resolution and international integration. These orientations also contribute to the national objective of reaching at least two million enterprises by 2030 and developing a strong contingent of entrepreneurs and leaders of major economic groups with sufficient capacity and competitiveness in domestic and international markets.
To achieve these goals, the Ministry of Justice, as the central agency responsible for legal aid, is implementing a series of key tasks.
The Ministry is developing legal aid models tailored to different types of enterprises and business sectors, with preferential mechanisms for household businesses, enterprises in remote and disadvantaged areas, women-owned businesses and socially impactful enterprises.
In terms of institutional reform, the immediate focus is amending Decree 55/2019/ND-CP to address shortcomings identified after five years of implementation. The revision aims to expand the beneficiaries of legal aid beyond SMEs to include household businesses, while establishing a general mechanism for enterprise legal assistance and priority mechanisms for specific groups in accordance with Party Resolutions.
At the same time, responsibilities of ministries, sectors, localities and business associations in addressing legal difficulties for enterprises need further clarification. An important direction is to increase funding levels for legal consultancy support to ensure consistency with other enterprise-support policies.
The Ministry of Justice is also drafting detailed regulations on the model and operation of Enterprise Legal Support Centers, aimed at resolving legal obstacles and disputes both domestically and internationally. Alongside this effort is the timely adjustment of regulations governing the operation of the National Law Portal so that it functions as a unified gateway for people’s and enterprises’ access to legal information, funded by the state budget and managed by the Ministry of Justice.
The Ministry is further studying regulations to provide certain free legal consultancy services for small and micro enterprises, business households and business individuals, as stipulated in Article 13 of Resolution 198/2025/QH15 of the National Assembly on special mechanisms and policies to promote private sector development.
Alongside institutional improvement, the Ministry has identified strengthening state management of legal aid for SMEs as a core task. This includes regular guidance, clarification and resolution of legal obstacles arising from enterprises’ actual needs. Inspection, evaluation and review activities will be reinforced to develop a set of criteria for assessing the effectiveness of SME legal support.
In addition, legal support methods will be diversified through communication programs, workshops, dialogues and online legal consultancy services. The application of digital technologies and artificial intelligence is expected to improve efficiency, reduce costs and expand access to legal information for enterprises nationwide.
Furthermore, the team of legal consultants and officials working on legal support will be strengthened and provided with specialized training to meet new requirements. This is considered a decisive factor in ensuring the quality of legal services and enabling enterprises to operate with confidence in a transparent and stable legal environment.- (VLLF)
