Nation to link procedures for grant of work permits and criminal record certificates for foreign employees
A pilot program on linking procedures for grant of work permits and criminal record certificates for foreign employees would be implemented in Hanoi, Thua Thien Hue and Ba Ria-Vung Tau, according to the latest draft decision proposed by the Ministry of Labor, Invalids and Social Affairs.

A pilot program on linking procedures for grant of work permits and criminal record certificates for foreign employees would be implemented in Hanoi, Thua Thien Hue and Ba Ria-Vung Tau, according to the latest draft decision proposed by the Ministry of Labor, Invalids and Social Affairs.

Currently, these procedures are regulated by separate laws and carried out by different entities.

Work permits are granted under the Labor Code that requires employers to prepare dossiers of application for work permits for their employees. Meanwhile, the Law on Judicial Records provides that foreigners must come in person to provincial-level Justice Departments to request grant of criminal record certificates.

In order to help simplify administrative procedures, the draft facilitates the pilot simultaneous implementation of such two procedures in the cyber environment without requiring data for identification or e-authentication of foreign employees.

Accordingly, a foreign employee would submit only one dossier of application for a work permit and a criminal record certificate. The entire time of dossier processing and appraisal would be 15 working days after the valid dossier is received.

The pilot program would be implemented in one year from the effective date of the decision.- (VLLF)
