The National Assembly has recently passed the revised Law on Cultural Heritage, which, compared to its 2001 version, introduces several noteworthy new provisions, especially those on the repatriation of Vietnam’s antiques.
The Law on Cultural Heritage clearly stipulates the management of national vestiges, antiques and precious objects and handling of the handover of newly-found national vestiges, antiques and precious objects as well as the purchase of vestiges and antiques with Vietnamese origin and bring them back to Vietnam.
Scheduled to take effect on July 1 this year, the 95-article Law adds provisions on the establishment of cultural heritages by type of ownership, i.e., all-people ownership, common ownership and private ownership in accordance to the Civil Code and other relevant laws; and the State’s policy for the protection and upholding of the values of cultural heritages.
The law also provides a complete legal framework for the use and exploitation of cultural heritages, the building of a national database on cultural heritages, and digital transformation and promoting social resources for protection and upholding of the values of cultural heritages.
It prescribes specific cases of adjustment of protection boundaries of relics, world heritage sites and their buffer zones; and principles and competence to adjust the boundaries of protection areas.
It also specifies the rights, obligations, and responsibilities of organizations, individuals and agencies in the management, protection and promotion of cultural heritages as well as prohibited acts and responsibilities of organizations and representatives assigned to manage and use relics.- (VLLF)
