CIRCULAR No. 01/2009/TT-BXD: Condominium deeds to be issued more quickly

Within that time limit, which is prescribed in Construction Ministry Circular No. 01/2009/TT-BXD of February 25, guiding the issuance of house ownership certificates and the form of condominium apartment sale and purchase contracts between housing project investors and their clients, a competent authority should issue an ownership certificate to a condominium apartment owner within 30 days after receiving his/her valid application dossier.

Such a dossier comprises a basic dossier for the whole apartment building and a dossier for the apartment. A basic dossier, which must be completed and submitted by the housing investor to the certificate issuer within 30 days after the apartment building is put into use, include documents on the housing investment project (project approval or investment decision, decision approving the 1:500-scale detailed plan and written consent to the general site plan), papers on the land plot (land use right certificate, land allocation decision and land use levy payment receipts), other relevant land plans and house architecture drawings, and a list of apartments and areas under private ownership applied for certificates.

Also within 30 days after apartment owners complete paying purchase money under sale and purchase contracts for their apartments, housing dealers (sellers) should complete and submit to the certificate issuer dossiers of all apartments. A condominium apartment sale and purchase contract must have separate provisions on spaces under co-ownership (corridor, common passage, elevator and parking lot) and those under private ownership, use rules applicable to inhabitants and operation and maintenance fees.

This Circular takes effect on April 11 and supersedes relevant provisions of Construction Ministry Circular No. 05/2006/TT-BXD of November 1, 2006, on issuance of house ownership certificates to apartment owners.-
