Contractor appointment to be applied for socio-economic recovery and development bidding packages
Bidding packages under the Program on socio-economic recovery and development specified in Government Resolution 11/NQ-CP dated January 11, 2022, would be allowed to select contractors through appointment, provided they obtain decisions approving contractor selection results no later than December 31 next year and fully satisfy the conditions provided in Article 22.2 of the Bidding Law.

It is highlighted in a draft circular recently released by the Ministry of Planning and Investment.

Specifically, the draft circular guides contractor appointment for consultancy bidding packages, bidding packages serving relocation of technical infrastructure facilities, bidding packages for compensation, site clearance and resettlement, and construction bidding packages under national important projects, large-scale important infrastructure projects in transport and health infrastructures covered by the Program of socio-economic recovery and development, and projects on construction of the eastern section of the North-South expressway during 2021-25.

To be eligible for contractor appointment, a bidding package must meet one of the following three conditions.

First, the bidding package needs to be performed immediately to ensure project progress.

Second, a notice of invitation for bids, notice of invitation to pre-qualification or notice of invitation for expression of interests for the bidding package has been published and online bidding has been conducted but the bid solicitor receives no bid dossiers, dossiers of participation in pre-qualification or dossiers of expression of interests or none of participating contractors satisfies capacity and experience requirements or none of bid dossiers satisfies basic requirements set in the bidding dossier.

Third, there is only one contractor that can perform the bidding package for specific technical reasons.

The Ministry of Transport and the Ministry of Health would formulate and issue criteria for evaluation of dossiers of proposals and process and procedures for contractor appointment for uniform application to each type of bidding package.- (VLLF)
