DECREE No. 40/2008/ND-CP: Liquor producers face strict quality, trademark requirements

All liquor makers, including well-known villages in which liquor production by traditional manual methods is encouraged, are required to obtain business registration certificates for this line of production and business before January 1, 2010.

Under Government Decree No. 40/2008/ND-CP of April 7, an enterprise wishing to be licensed to produce liquor must get a business registration certificate for liquor production, have machinery and technological chain for liquid production up to national food quality, hygiene and safety standards, lawfully own registered liquor trademarks or be licensed by protected liquor trademark owners in Vietnam, and employ infectious disease-free persons to work directly in liquor-making processes.

Enterprises that fail to commence their liquor production within six months of being licensed without plausible reasons certified by competent authorities will have their licenses revoked.

When requested by agencies in charge of trade or health, all entities that produce or trade in liquor should publicize information on ingredients and alcohol content of their liquor products as well as the harm of alcohol abuse in the mass media. They may advertise liquor products or promote liquor sales only after obtaining these authorities’ permission. Liquor outlets are not allowed to sell liquor to persons aged under 18 years.-
