This is included in Government Decree No. 01 dated January 6, 2017, revising a number of decrees detailing the implementation of the Land Law, including Decree No. 43/2014/ND-CP, Decree No. 44/2014/ND-CP and Decree No. 47/2014/ND-CP.
Decree No. 01/2017/ND-CP details the compensation when the State recovers land allocated ultra vires before July 1, 2004, for which land use levy has been paid but certificates of land use rights have not been granted.
Specifically, those using land before October 15, 1993, and holding papers proving their payment are entitled to compensation for the area and category of land allocated.
For land allocated ultra vires from October 15, 1993, to before July 1, 2004, land users may receive full compensation for the area and category of land allocated if holding papers proving their payment for the use of the allocated land area under the 1993 Land Law.
In case having papers proving their land use levy payment which is lower than the levels prescribed under the 1993 Land Law, land users are still entitled to compensation for the area and type of land allocated, but with deduction of the payable land use levy (if any) under regulations on land use levy upon grant of certificates of land use rights.
This deduction also applies to users of land allocated ultra vires before July 1, 2004, who do not hold papers proving their land use levy payment.- (VLLF)
