Deputy Prime Minister Pham Gia Tuc has recently signed Decision 1916/QD-TTg, promulgating a plan for implementing National Assembly Resolution 37/2026/QH16, so as to remove legal obstacles affecting the state economic sector and private economic sector, as well as science, technology and innovation activities.

Resolution 37 is designed to establish specific mechanisms for handling violations arising in areas related to the state economic sector and private economic sector, and science, technology, innovation and digital transformation. These are intended to encourage and protect cadres, civil servants, public employees and other individuals and those who are proactive and innovative in task performance and dare to act for the common good, while upholding the principle of not criminalising economic relations.

In light of this, the plan seeks to realise the provisions of Resolution 37 across ministries, sectors and localities, providing a clearer framework that encourages innovative decision-making while maintaining effective safeguards against corruption, negative practices and policy abuse.

A key task set out in the plan is to review the existing legal system to identify regulations that need to be amended, supplemented, replaced or annulled to ensure consistency with Resolution 37. This is crucial against the backdrop that investment, business and technological innovation often advance faster than the improvement of the relevant legal provisions.

The plan calls for information dissemination, training and professional guidance to help officials responsible for implementation as well as related organisations and individuals fully understand the scope of application of the specific mechanisms. It also sets out procedures for receiving and handling reports, feedback and recommendations to promptly address difficulties arising during implementation.

Relevant agencies are required to review and handle cases, including criminal cases, falling within the scope of regulation of Resolution 37, with a view to protecting those who take courage in the public interest, while ensuring accountability for deliberate violations or policy abuse.

In the judicial sector, the Ministry of Public Security is assigned to coordinate with related agencies in drafting a joint circular guiding the specific mechanisms and policies concerning criminal affairs, criminal procedures and the execution of criminal judgments under Resolution 37.

As for personnel management, the Ministry of Home Affairs is tasked with reviewing and revising regulations on disciplinary measures against cadres and civil servants who commit violations in areas governed by Resolution 37 while implementing specific mechanisms and policies for the common good.

Meanwhile, the Ministry of Public Security and the Ministry of National Defence are assigned similar tasks for members of their forces.- (VLLF)
