Law on Notarization expected to facilitate digital transformation in notarial activities

From July 1, e-notarization will be formally carried out by either in-person or online mode, according to the 2024 Law on Notarization.

With offline e-notarization, applicants enter into transactions with notaries, then notaries and notarization practice organizations certify the transactions with digital signatures to create e-notarized documents. Meanwhile, online notarization is effected when the applicants do not show up at the same place and enter into transactions by online mode to the direct witness of notaries.

As required by the 76-article Law, e-notarization will have to adhere to strict principles to maintain the integrity of data messages and ensure the confidentiality of information. Information in data messages are accessible and usable for reference purpose.

E-notarization will be offered by notaries and notarial practice organizations that fully meet the law-specified requirements for providing e-notarization services.

E-notarized documents will become valid from the date they are digitally signed by notaries and notarization practice organizations.

Regarding notarization training, the Law says that judges, procurators, lawyers and those having five or more years’ working experience, who are exempted from notarization training under the 2014 Law on Notarization, must still complete a six-month notary training course if wishing to act as notaries.

In addition, in order to get hands-on experience, probationary notaries will have to undergo 12-month apprenticeship duration counting from the effective date of apprenticeship registration decisions. They must abide by regulations on working time issued by notarial practice organizations to ensure apprenticeship outcomes.- (VLLF)
