With a view to facilitating production and trade activities of enterprises in industrial parks and economic zones, the Ministry of Labor, Invalids and Social Affairs has recently allowed provincial-level People’s Committees to authorize industrial park management boards (IPMBs) to perform the state management of labor in these parks.
Under Circular 17/2023/TT-BLDTBXH, provincial-level People’s Committees may authorize IPMBs to receive notices of layoff from enterprises in their parks under Article 42.6 of the Labor Code.
Worthy of note, contents of authorization must be agreed upon between authorizing and authorized entities and conformable with local realities and IPMBs’ existing human resources in charge of labor.
The period of authorization will be stated in letters of authorization.
The new regulation also states that a provincial-level People’s Committee has the right to terminate the authorization before the expiration date if the authorized body fails to properly perform the state management task, or based on the practical conditions and requirements for state management of labor in the locality.
The termination will be notified in writing, clearly stating the reason, to relevant agencies for realization.
IPMBs are responsible for properly and fully performing authorized tasks so as to ensure the effective state management of labor in their IPs, and held responsible before authorizing agencies and law for their performance.-
