New points of the Law Revising Law on Organization of the National Assembly
The National Assembly (NA) on February 17 approved the passage of the Law Revising the Law on Organization of the National Assembly (the Law), with amendments related to the legislative authority of the NA, suspension of the performance of duties and the exercise of powers of a NA deputy, among others.

The National Assembly (NA) on February 17 approved the passage of the Law Revising the Law on Organization of the National Assembly (the Law), with amendments related to the legislative authority of the NA, suspension of the performance of duties and the exercise of powers of a NA deputy, among others.

The Law clearly provides the legislative authority of the NA and specifically delegates power to the Government and its agencies.

Accordingly, the NA only regulates issues of stability and long-term value; provisions on human rights, rights and obligations of citizens, judicial proceedings, and issues that greatly impact the people’s life, and the relationships between the State and citizens and society.

For provisions on the state management of various sectors, new issues that are innovative for development promotion or have yet to be tested in practice, the NA only provides principles and orientations to institutionalize the Party’s guidelines. The Government and agencies in the state apparatus are empowered to concretize and implement such regulations in conformity with the implementation capacity of each agency, organization or local administration, and socio-economic development requirements in each period. Particularly, the NA will no longer regulate provisions on administrative procedures, professional and technical standards, and those prone to frequent changes.

The Law also adds a case in which NA deputies are subject to suspension of performance of duties and exercise of powers as a NA deputy.

Accordingly, the NA Standing Committee will decide to suspend the performance of duties and exercise of powers of a NA deputy who is a cadre, civil servant or public employee when there is a ground for giving a caution or imposing a higher disciplinary form against the NA deputy, and there is a written request for suspension of performance of duties and exercise powers of such NA deputy.

A NA deputy may resume his duties and powers as a NA deputy when a competent agency issues a decision or conclusion stating that he is innocent and not subject to any disciplinary form.

In case a NA deputy is disciplined, depending on the nature and extent of his violation, he may apply to resign from performing the duties of a NA deputy. The NA Standing Committee may consider and decide whether to allow him to resume his duties and powers as a NA deputy or propose the NA to remove him from office.

The Law is silent about the fixed number and names of NA agencies. The NA will specify the number and names of its agencies through specific resolutions. This will help facilitate the reorganization and streamlining of the apparatus in each specific period.- (VLLF)
