The Government has recently introduced significant changes for entities providing data-related products and services, including new notification and reporting obligations and removal of several market-entry requirements.
Under Decree 347/2026/ND-CP, from September 15, organisations providing data analysis and aggregation products and services are required to notify the National Data Centre before commencing their operations.
They must also submit annual reports on the provision of such products and services to the Ministry of Public Security via the National Data Centre. Reports must be submitted before December 20 every year and cover the period from December 15 of the preceding year to December 14 of the reporting year. Unscheduled reports may also be required.
The notification requirement also applies to those that commenced their operations before September 15. They must notify their operation to the National Data Centre within 20 working days from the date of operation commencement.
Besides, the decree abolishes the previous requirement of obtaining certificates of eligibility to provide data analysis and aggregation products and services. The requirement formerly applied to several categories, including level-3 and level-4 products and services used in information systems of state agencies; products and services capable of posing risks to national defence, national security, social order and safety or public health; those connected to or sharing data with national or sector databases; and those using core or important data.
For other activities that remain subject to certification, the Ministry of Public Security will issue three categories of certificates, namely certificate of eligibility for provision of data exchange platform services; certificates of eligibility for provision of data intermediary, analysis and aggregation products and services; and certificates of eligibility for provision of data analysis and aggregation products and services.
The decree sets out new personnel requirements for organisations providing data exchange platform services. Accordingly, such an organisation must employ at least five persons possessing a university degree or higher qualifications, have at least 40 per cent of total employees working on a permanent basis and 30 per cent possessing a certification of completion of a relevant training course provided by a competent agency or organisation.
Eligible areas of training include data science, data analysis, data management, consultancy, brokerage, trade promotion, asset management and data appraisal.- (VLLF)
