Persons serving home detention sentences to be subject to electronic monitoring

Electronic monitoring would be implemented for offenders eligible for early release, convicts serving suspended sentences, persons undergoing non-custodial reform, and persons subject to house arrest or probation if they once breached the obligations associated with their sentences.

This new provision is outlined in a draft law on execution of custody, temporary detention and house arrest recently released by the Ministry of Public Security (MPS).

As required by the draft law, such persons would have to wear electronic monitoring devices during the period of applying deterrent measures so that authorities could track their whereabouts and remotely identify them. To this end, an integrated system would be developed to monitor any unlawful removal or invalidation of these devices.

According to the MPS, electronic monitoring of persons serving community-based sentences would prevent them from escaping or repeating crimes, thus contributing to maintain social order and safety.

The MPS also stresses the necessity for establishing a ministerial-level Electronic Monitoring Center along with specifying the legal status, tasks and powers of such center in electronic monitoring.- (VLLF)
