Private data would not be publicized without consent of data subjects: MOPS
Data that may not be disclosed include personal data collected without the consent of data subjects, data classified as state secrets and data affecting the national defense and security, according to a draft decree prepared by the Ministry of Public Security (MOPS) to guide the 2024 Data Law.

Data that may not be disclosed include personal data collected without the consent of data subjects, data classified as state secrets and data affecting the national defense and security, according to a draft decree prepared by the Ministry of Public Security (MOPS) to guide the 2024 Data Law.

Also provided in the draft, data that undermine the interests of the Party, the State, national interests, diplomatic relations, social ethics, community health, or pose harms to the life, health, lawful rights and interests of organizations and individuals, would also not be made public.

Meanwhile, data concerning business secrets, private life, personal secrets or family secrets might be disclosed if data owners, data subjects, or family members so agree, respectively.

While performing their duties, heads of state agencies or socio-political organizations might decide to disclose data without the consent of data subjects or data owners if the disclosure serves public interests, community well-being or for other purposes specified by law.

The MOPS would make and publicize the list of open data managed by state agencies.

The draft encourages individuals and organizations to share their data with state agencies for public interests such as healthcare, climate change mitigation, transportation enhancement, compilation and dissemination of official statistics, and improvement of public service provision, policy-making and scientific research.

Organizations and individuals might voluntarily share and provide data after obtaining consent of data subjects to process their personal data or being authorized by data owners to use their non-personal data.- (VLLF)
