Procedures for foreign lecturers to apply for confirmation of work permit exemption

I’m a German lecturer and have just received a job offer from a university in Vietnam. In case I’m exempt from work permit, what are the procedures for applying for confirmation of work permit exemption?

As per Article 8 of Decree 152, the university where you are expected to work will have to submit a dossier of request to the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs of the province or centrally run city where you are going to work for the latter to issue a confirmation of work permit exemption for you at least 10 days before the date you start working.

The dossier, which may be hand-delivered or submitted via electronic means or by post, must comprise:

(i)  A written request for confirmation of work permit exemption;

(ii) Your health certificate, issued by a qualified foreign or Vietnamese hospital or clinic and valid for 12 months, counted from the date of its signing or to the date of dossier submission, or a certificate of physical fitness as specified by the Minister of Health;

(iii) A written approval of the university-your employer’s demand for foreign workers.

However, if you falls into the second case as mentioned above and have obtained a certification from the Vietnamese Ministry of Education and Training, such paper will not be required;

(iv) A certified copy of your valid passport; and,

(v) Papers proving your eligibility for work permit exemption.

Noticeably, the papers specified in Items (ii), (iii) and (v) must be originals or certified copies. In case they are issued by foreign authorities, they must be consularly legalized, translated into Vietnamese and the translations must be certified, except cases exempt from consular legalization under treaties to which Vietnam and concerned foreign countries are contracting parties or on the principle of reciprocity or in accordance with Vietnam’s law.

Within five working days after receiving a complete dossier of request for confirmation of work permit exemption, the Ministry of Labor, Invalids and Social Affairs or provincial-level Departments of Labor, Invalids and Social Affairs will issue a certificate of work permit exemption. In case of refusal to issue such a certificate, it will issue a written reply, clearly stating the reason.

The certificate of work permit exemption will be valid for two years, and may be re-issued for a validity period of another two years at most.-
