In furtherance of Government Resolution 66.7/2025/NQ-CP on data-driven reduction and simplification of administrative procedures and Decree 278/2025/ND-CP on data connection and sharing among agencies within the political system, the Ministry of Justice issued Decision 1046/QD-BTP on April 20, 2026.
The decision announces data on the registration of security interests in movables, annual crops and makeshift works that can be used in replacement of paper documents in settling administrative procedures.
It also specifies the scope of exploitable data and establishes a framework for state agencies to connect to and utilise security interest registration data during task performance, helping gradually realise a data-driven administration system.
Decision 1046 states that data on the registration of security interests in movables within the Ministry of Justice’s competence may be announced as eligible for exploitation and use as substitutes for paper documents as components of an administrative procedures dossier. Consequently, registration data no longer serves solely for registration and information provision upon request but becomes an official information source for use by state authorities in duty performance.
Scope and use value of data
Decision 1046 announces the specific categories of information shared from the Database on Security Interests, including information on registration, securing parties, secured parties and collateral. This categorisation not only serves data management purposes but also helps determine registration status, identify data subjects and accurately verify the assets being used to secure obligation performance.
Among the disclosed information fields, the registration time holds legal significance as it serves as a basis for establishing effect against third parties and determining the order of priority among co-existing rights over a single asset. Furthermore, the decision designs collateral information based on asset characteristics, e.g., chassis numbers for vehicles, registration numbers for fishing vessels or grounds giving rise to property rights, thus facilitating automated data collation and exploitation by specialised systems.
Worthy of note, data announcement does not alter the legal value of registration. Shared data merely reflects the information recorded in the Database on Security Interests and is substitutable for paper documents within the statutory scope. It does not automatically certify asset ownership or the effect of security agreements. The verification of these aspects must still comply with law and be collated with relevant specialised databases.
Data connection associated with control and security assurance
For data to be genuinely exploited in administrative clearance, Decision 1046 released technical connection guidelines, establishing a standardised method for exploiting the Database on Security Interests. This ensures that every exploitation request is controlled prior to data provision while clarifying who is extracting data, and which data is being accessed, at what time and for what purpose.
In addition, the technical documentation standardises exploitation methods to meet operational needs. Authorities may search by registration number when wishing to verify a specific transaction, by the identification number of the securing party to identify registrations linked to a data subject or by chassis number for vehicles. Standardising search criteria enables information systems to exchange and process data automatically without manual reconciliation.
To ensure data is utilised as a basis in state management activities, the decision sets strict requirements for authentication and system security. Exploitation results are provided via application programming interfaces (APIs), incorporating authentication mechanisms, electronic signatures and timestamps to guarantee data integrity and traceability when necessary. In addition, only systems meeting information security requirements and approved under regulations are allowed to be connected to the Database on Security Interests. Such authentication and traceability help build trust of data when paper documents are replaced in state management activities.
Under Decision 1046, the Database on Security Interests will not only serve registration purposes but also constitute a crucial legal data source, helping improve the quality of administrative clearance, support policymaking and foster a safe, transparent credit market in the digital economy.- (VLLF)
