Protection of personal data in cyber environment to be brought into law

Personal data used for registering social media accounts or over-the-top (OTT) services would be neither allowed to be disclosed nor processed without the consent of data owners, according to the latest draft Law on Personal Data Protection recently released by the Ministry of Public Security (MPS).

Under the 68-article draft, organizations and individuals providing social media or OTT services would have to protect personal data of Vietnamese citizens when operating in the Vietnamese market or featuring on mobile app stores designated for the Vietnamese market.

They would be obliged to clearly notify personal data contents to be collected when data owners install and use social media or OTT services. The unauthorized collection or collection beyond the scope agreed upon with customers would be prohibited.

Eavesdropping, wiretapping or recording phone calls and reading text messages without the consent of data owners would constitute violations of law.

The draft law also specifies that social media or OTT service providers would not be allowed to require photos of citizen identity cards or identity cards for account verification. Meanwhile, they would have to provide options to allow users to refuse the collection and sharing of browser cookies.

They would have to provide specific and clear notices about sharing of personal data as well as application of confidentiality-keeping measures when carrying out advertising and marketing activities based on customers’ personal data.- (VLLF)
