Violators of school bus safety regulations to face heavy fines
School bus owners and drivers would be subject to a range of hefty fines if violating safety regulations on school bus services, according to the latest draft released by the Ministry of Public Security.

School bus owners and drivers would be subject to a range of hefty fines if violating safety regulations on school bus services, according to the latest draft released by the Ministry of Public Security (MPS).

As per the draft decree on sanctioning of administrative violations in the field of road traffic order and safety, the MPS proposed a fine of VND 1-2 million (USD 40-80) for acts of failing to instruct schoolchildren to sit in their appropriate positions in automobiles; or driving vehicles transporting preschool or primary school children without seat belts or seats designed for such children.

A fine of VND 2-3 million (USD 80-120) would be imposed on persons who drive automobiles to carry primary or preschool children but fail to meet requirements on number of bus monitors specified in the 2024 Law on Road Traffic Order and Safety. This fine would also be applied to school bus drivers that have under two years’ experience in passenger transport or drivers and bus monitors who have not yet been trained in assurance of safety for schoolchildren.

Drivers of school buses without CCTV systems for child monitoring or equipment for warning against or preventing children abandonment in vehicles or those failing to meet the requirement on lifespan or paint colors for school buses might face a fine of VND 4-6 million (USD 161-241) and a 6-point reduction in their driver licenses. Owners of such non-compliant buses would incur a fine of VND 4-6 million (USD 161-241), for individuals or VND 8-12 million (USD 322-483), for institutions.

Also under the draft decree detailing the Law on Road Traffic and Order, the MPS requires buses specially designed for transporting schoolchildren to be painted in dark yellow on the outside and bear a school bus sign at the front and on both sides above the windows.

Commercial automobiles used for transporting schoolchildren would not be obliged to have a dark-yellow exterior but still must bear a school bus sign.- (VLLF)
